Returning to Legal Employment
Overview
The Reactivation Employment Permit helps certain non-EEA nationals return to lawful employment after they previously worked legally under an Irish employment permit but fell out of the system through no fault of their own, or experienced workplace mistreatment or exploitation.
Before applying for the employment permit, the person must obtain temporary Stamp 1 permission and a “Reactivation Employment Permit” letter from the Department of Justice through Immigration Service Delivery.

Out of Status in Ireland
Lost permission but remained in Ireland.
Employment Breakdown
Redundancy or employer non-compliance.
Return to Legal Employment
Secured a qualifying job offer in the State.
Key Compliance Points
- The employee must generally remain with the sponsoring employer for 12 months.
- Limited exceptions may apply where employment ends through no fault of the employee.
- Future permit applications remain subject to standard eligibility criteria.
- Prior immigration authorisation is required before DETE submission.
- Change of Employer is not available under Reactivation.
- A new GEP or CSEP is required to change employer.

- Typically available after 12 months.
- Subject to financial and eligibility requirements.
- Spouses may receive Stamp 1G permission.
- Time spent in Ireland as a dependant may count towards naturalisation, subject to conditions.
Future Immigration Pathways
After approximately 5 years of reckonable residence, eligible applicants may qualify for Stamp 4 permission and, subject to eligibility, Irish naturalisation.
