Overview
A Spouse of Irish National application allows an eligible non-EEA national living in Ireland to request residence permission based on a genuine marriage or recognised civil partnership with an Irish citizen.
This formal application route is generally used where the applicant entered on a Short Stay ‘C’ visa, is an asylum seeker, does not hold valid immigration permission or has been refused registration as the spouse or civil partner of an Irish citizen.
Marriage or civil partnership does not create an automatic right to live in Ireland. Immigration Service Delivery assesses whether the relationship is valid and committed, whether the couple genuinely lives together and whether the other eligibility requirements are satisfied.
MWeds assesses the applicant’s circumstances, provides tailored document instructions, reviews the supporting evidence and assists with submitting the application through the ISD Customer Service Portal.
Eligibility
- The applicant must be at least 18 years old.
- The applicant must be married to, or in a recognised civil partnership with, an Irish citizen.
- The marriage or civil partnership must have been entered into freely and lawfully and must be recognised under Irish law.
- Both partners must be living together in Ireland as a family unit.
- Both partners must intend to continue living together in Ireland.
- The relationship must be genuine and committed.
- The Irish spouse or civil partner must generally have earned at least €40,000 during the previous three years, excluding State welfare benefits.
- The applicant must be of good character and disclose relevant immigration and criminal history.
- The couple must demonstrate that granting permission would not create an undue burden on the State.
- Approval remains discretionary and is assessed individually by Immigration Service Delivery.
Who Can Apply?
You may apply for EUTR5 Retention of Residence if you are a non-EU family member of an EU/EEA or Swiss national and one of the following applies:
- Death of the EU citizen:
- You had resided in Ireland as a family member of the EU citizen for at least one year before their death.
- Divorce or annulment of marriage / civil partnership:
- The marriage or civil partnership lasted at least three years, including at least one year of residence in Ireland before the divorce or annulment proceedings began; or
- You have custody of the EU citizen’s child; or
- You have access rights to the EU citizen’s child in Ireland; or
- Particularly difficult circumstances apply (e.g. domestic violence).
- EU citizen’s departure from Ireland:
- You are the parent or primary carer of an EU citizen child who remains in school in Ireland.
Applicants must continue to meet the conditions of residence (e.g. working, self-employed, studying, or self-sufficient) after the change in circumstances.
