EUTR4 Review of an EU Treaty Rights Decision
Overview
An EUTR4 review allows an applicant to request reconsideration of certain adverse decisions made under EU Treaty Rights. It may be used following the refusal of an EUTR1, EUTR1A, EUCC, EUTR2, EUTR3 or EUTR5 application, or following a decision to revoke an EU Treaty Rights residence card, residence document or permission.
The EUTR4 review must identify why the original decision should be reconsidered. Depending on the circumstances, the grounds may concern an error of fact, an error of law, information that was not considered or a relevant change that was not previously assessed.

A review does not guarantee that the original decision will be changed. Immigration Service Delivery decides the request based on the completed form, the stated grounds and the supporting evidence provided.
Applicants seeking to retain residence rights following divorce, death or the departure of an EU family member may require the separate EUTR5 process rather than an EUTR4 review.
Eligibility
To request an EUTR4 review, you must:
- Have received a refusal concerning an EUTR1, EUTR1A, EUCC, EUTR2, EUTR3 or EUTR5 application, or a decision revoking an EU Treaty Rights residence card, document or permission.
- Provide the relevant decision letter.
- Explain why the decision involved an error of fact or law.
- Normally submit the review request within 15 working days of receiving the decision.
Who Can Apply?
You can request a review if:
- You have received a refusal letter from ISD regarding an application under EU Treaty Rights (EUTR1, EUTR2, or EUTR3); and
- You wish to challenge that refusal within the allowed timeframe.
Both EU nationals and their non-EU family members can use the EUTR4 process, depending on whose application was refused.
Supporting Documentation
Your review submission should include:
- A completed EUTR4 form
- A copy of the refusal letter
- A detailed explanation or cover letter outlining your grounds for review
- All required documents from the checklist provided by your MWeds consultant
- Any additional or updated supporting documents relevant to the reasons for refusal
Processing
Time
Requests for review are processed by Immigration Service Delivery (ISD). Processing usually takes around 6–8 months, depending on case complexity and ISD workload.
- The EUTR4 Request for Review must be submitted within 15 to 30 days from the date of the refusal decision, depending on the timeframe stated in your refusal letter.
- ISD may specify either 15 working days or 30 calendar days, so it is important to check your refusal letter carefully.
- Late requests are generally not accepted by ISD unless you can show exceptional circumstances for the delay.

Eligible family members include (depending on circumstances)
- Spouse or civil partner
- Child or dependent child (under 18, or dependent adult child)
- Dependent parent(s) of either the EU citizen or their spouse/partner
- In some cases, extended family members (subject to prior ISD approval)

Important Notes
- You must submit your review within 30 days of the refusal letter date or according to the deadline specified in the refusal letter.
- The review does not introduce new grounds, it must address the same application and circumstances.
- Providing clear, complete, and relevant documentation increases the chance of a successful outcome.
- If your EUTR1 permanent 5-year visa was refused, you will normally be granted a temporary Stamp 4 while the review or appeal is ongoing.
- However, if your initial EUTR1 application was refused (and you had not yet received the approval for the temporary Stamp 4), ISD does not issue temporary permission during the review process.
- If the refusal is upheld, you may seek further legal advice regarding judicial review or other options.
