EUTR3 Permanent Residence Card for Non-EEA Family Members
Overview
The EUTR3 Permanent Residence Card is for an eligible non-EEA family member who has lived continuously in Ireland for more than five years under EU Treaty Rights as the family member of an EU, EEA or Swiss citizen.
Applicants normally need to hold a current Residence Card and demonstrate compliance with the applicable EU Treaty Rights conditions throughout the qualifying period. A person whose retention of residence rights has been approved may also qualify.

An approved Permanent Residence Card is valid for ten years and permits the holder to work or operate a business in Ireland. It does not grant Irish citizenship.
EU, EEA and Swiss citizens seeking proof of their own permanent residence should use the separate EUTR2 Permanent Residence Certificate process.
Eligibility
To qualify, you must demonstrate that:
- Continuous 5-year residence in Ireland with your EU citizen family member;
- Evidence that your EU family member was exercising Treaty Rights during those 5 years; and
- Ongoing family relationship and cohabitation (where applicable).
Absences from Ireland should be kept under 70 days per year, or up to 100 days in justified circumstances (such as illness, study, or temporary work abroad).
Longer absences may break the required “continuous residence” and could lead to a refusal by ISD.
Who Can Apply?
You may apply if you are a non-EU/EEA or non-Swiss national who is the qualifying family member of an EU/EEA or Swiss citizen, and you have both:
- Resided legally in Ireland for at least 5 continuous years; and
- Your EU family member has been exercising EU Treaty Rights in Ireland during that period (as a worker, self-employed person, student, or self-sufficient individual).
Supporting Documentation
Applicants must provide evidence of:
- Relationship to the EU citizen (e.g. marriage, birth, or partnership certificate)
- Residence in Ireland and proof of cohabitation for the qualifying period
- EU citizen’s activity in Ireland (e.g. employment, self-employment, study, or self-sufficiency)
Processing
Time
- Applications are processed by Immigration Service Delivery (ISD).
- Processing usually takes around 6 months, depending on case complexity and ISD workload.
